GENERAL CONDITIONS OF SALE

The present document (General Terms of Sale) defines the conditions applicable to sales concluded between, on the one hand, the individuals making a purchase through the RIZEN MOTO website www.rizen-moto.com, hereinafter referred to as "the customer," and on the other hand, the company hereinafter referred to as "RIZEN moto."

1. APPLICATION OF THE TERMS OF SALE

These general terms of sale apply to any order placed on the website www.rizen-moto.com. RIZEN moto reserves the right to adapt or modify these general terms of sale at any time. In the event of modification, the general terms of sale in force at the time of the order will apply to each order. The acquisition of a good or service through this site implies unconditional acceptance by the buyer of these terms of sale.

2. OFFER

All product and delivery offers are valid in France, within the limits of available stock. The products sold are described as accurately as possible. The photos of the products on the site are non-contractual.

3. ORDER

The order will only be recorded on the site if the customer is clearly identified by creating an account on www.rizen-moto.com. The customer can also log in to their existing account. Any order constitutes acceptance of the prices and description of the products available for sale. The contract is formed upon confirmation of your order. Upon validation of the customer's order, it will be forwarded to RIZEN moto's logistics. The customer will receive an automatic acknowledgment of receipt email as soon as their order is validated. The customer can obtain information about their order by contacting us at info@rizen-moto.com.

Regarding customized or made-to-measure products: The customer must send RIZEN moto the necessary elements for the creation of their personalized made-to-measure product within a maximum period of 6 months from the order date. After this period, the order will be canceled without refund. This period is reduced to 3 months if the order was placed during sales. No order can be canceled once RIZEN moto has received the personalized elements (color and measurements) from the customer. A credit note may be offered after agreement if the production of the said product is not in progress. To exercise their right of withdrawal in accordance with European regulations (only for standard and non-personalized products), customers have a period of 14 days.

4. VALIDATION OF ORDERS

Any order form signed by the consumer by "clicking" constitutes an irrevocable acceptance that can only be challenged within the limits provided for in these general terms of sale. The "click" associated with the authentication and non-repudiation process and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature. For made-to-measure and personalized products, the validation of the prototype is definitive. In the event of a dispute, no recourse will be possible if the delivered product is compliant with the prototype validated by the customer.

5. PRICES

Prices are indicated in the currency chosen by the user on the site and are subject to VAT. Be sure to keep your invoices. RIZEN moto reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time of the order registration, subject to availability. Shipping costs are set at €6.90. Products remain the property of RIZEN moto until full payment is made. During sales, promotional codes cannot be combined on discounted products.

5.1 RETURN POLICY

In accordance with Article L221-18 of the Consumer Code, the customer has a withdrawal period of 14 days to return their package from the date of receipt of their order for all standard and non-personalized products.

6. PAYMENT AND SECURITY

6-1 PAYMENT BY CREDIT CARD
On the site www.rizen-moto.com, you can pay by credit card using STRIPE.

6-2 PAYMENT IN 3 OR 4 INSTALLMENTS BY CREDIT CARD
On www.rizen-moto.com, you can pay in 3 or 4 installments by credit card using KLARNA. The buyer is solely responsible for the commitment they make to honor the installments of their staggered payment, the credit conditions being accepted by the buyer at the time of payment. By paying by card, you expedite the triggering of your order. Blue cards, VISA, and Mastercard are accepted. If you pay for your order in installments, you accept Klarna’s general customer conditions as well as the specific conditions of Klarna for RIZEN moto customers.

6-3 RETENTION OF TITLE
Products remain the property of RIZEN moto until full payment of the order has been collected by RIZEN moto. From the time of dispatch, the risks of delivered goods are transferred to the customer. All prototypes remain the intellectual property of RIZEN moto. Any partial or total reproduction may lead to legal action, including for the logo and the brand. In the event of the return of personalized or non-personalized products to RIZEN moto for a refund or exchange, RIZEN moto retains ownership of the merchandise both materially and intellectually. RIZEN moto is therefore free to reuse them for commercial purposes.

6-4 DEFAULT OF PAYMENT
RIZEN moto reserves the right to refuse to deliver or honor an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is currently being managed.

7. STANDARD AND CUSTOM PRODUCTS

7-1 CUSTOM PRODUCTS
Regarding custom products, RIZEN moto provides a measurement guide after payment is received, where the customer will find all the necessary points for taking measurements. The indications must be strictly followed. When sending your measurements, RIZEN moto commits to informing the customer if our team believes that the measurements have not been taken correctly and may request the customer to take new measurements properly to ensure the correct realization of the custom product. When the prototype is sent into production, the factory also ensures the proper compliance of the measurements. In case of inconsistencies in the measurements provided to the manufacturing factory, RIZEN moto may request the customer to provide new specific measurements, either partially or completely. It is the customer’s responsibility to provide the new measurements as soon as possible to avoid delaying production. RIZEN moto cannot be held responsible for any delay due to the transmission of incorrect measurements by the customer. Similarly, if the customer refuses to send the requested measurements and/or additional photos by RIZEN moto, the order will in no case be canceled but put on hold during the period of 6 months from the date of the order, as stipulated in the General Terms of Sale, Article 3. The customer will then not be able to claim any refund and may complete their order within these 12 months. In case of ordering during a sale period, this deadline is 3 months. An order will only be sent for production when it is complete. Orders from customers who have not provided the measurement photos so that RIZEN moto and the manufacturing factory can ensure their proper taking will be considered incomplete. In case of major impossibility to take photos, RIZEN moto cannot be held responsible for the measurements taken, and the customer waives the guarantee of the ordered product. In case of defects found upon receipt of their order, the customer cannot claim any compensation, exchange, or refund of any kind and cannot in any way claim RIZEN moto's responsibility or disparage the brand under penalty of legal action.

7-2 STANDARD PRODUCTS
Standard and non-personalized products can be exchanged free of charge within 14 days following the receipt of the order. Beyond this period, any return will be refused.

8. OUR GUARANTEES

Our made-to-measure products are guaranteed for parts and labor for a period of six months, with return to our warehouse according to the articles of these general terms of sale. According to Article R. 211-4 of the Consumer Code: “In contracts concluded between professionals, on the one hand, and, on the other hand, non-professionals or consumers, the professional cannot contractually guarantee the thing to be delivered or the service to be rendered without clearly mentioning that the legal guarantee applies, which obliges the professional seller to guarantee the buyer against all the consequences of defects or hidden flaws of the sold item or the service rendered.” Regarding custom and personalized items, RIZEN moto cannot be held responsible for any transmission of erroneous measurements by the customer.

RIZEN moto reminds the customer that differences in color, shade, saturation, and nuance may be noted between cowhide and kangaroo leather. No compensation will be granted in this case. RIZEN moto uses colors similar to those requested but cannot systematically produce the same color.

9. DELIVERY, SHIPPING & RETURNS

RIZEN moto commits to respecting the shipping time provided to you as an estimate.

9-1 SHIPPING
Non-personalized products and standard sizes are generally shipped within 48 hours; this period is given as an estimate and may vary depending on product availability from the supplier. For personalized and made-to-measure products, packages are shipped within 40 to 60 days after receipt of payment, validation of the prototype, and the client’s measurements by the manufacturing factory. These times are provided as an estimate; the customer will receive an email with an online tracking link when their order is shipped.

9-2 DELAY
In case of delivery delay, RIZEN moto cannot be held responsible or liable for any commercial gesture or compensation. It is the customer's responsibility to contact the carrier to request compensation. Similarly, RIZEN moto cannot be held responsible for delays or loss of packages in case of incorrect delivery address provided by the customer at the time of ordering.

9-3 CHANGE OF DELIVERY ADDRESS
It is the customer's responsibility to indicate the correct delivery address at the time of ordering. No change of delivery address will be accepted after the order has been confirmed.

10. COMPLAINTS

Any complaint must be made within a maximum period of 8 days after receipt of the order by sending an email to RIZEN moto. No complaints will be considered after this period.

11. APPLICABLE LAW

The sale of products is subject to French law.

Jurisdiction
The parties agree that any dispute related to the execution or interpretation of these general terms of sale will be the exclusive jurisdiction of the commercial courts of Paris.

12. ACCEPTANCE

The consumer acknowledges having read these general terms of sale prior to placing their order and expressly accepts them.
